1. Introduction
Welcome to EnuMenu ('we,' 'our,' or 'us'). EnuMenu is a brand operated by Kiran Sp. z o.o., a company registered in Poland. These Terms and Conditions ('Terms') govern your access to and use of the EnuMenu platform, including our website, mobile applications, and services (collectively, the 'Service').
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Definitions
- 'Account' means a unique account created for you to access our Service.
- 'Restaurant' means a business entity that subscribes to our Service to manage their digital menu and ordering system.
- 'Customer' means an end-user who accesses a Restaurant's menu through our Service.
- 'Subscription' means the paid plans available for accessing premium features of the Service.
- 'Content' means any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Service.
- 'Payment Provider' means third-party payment processing services (such as Stripe or Przelewy24) that Restaurants may use to accept payments from Customers.
3. Account Registration
To use certain features of the Service, you must register for an Account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your Account credentials
- Accept responsibility for all activities that occur under your Account
- Notify us immediately of any unauthorised use of your Account
We reserve the right to suspend or terminate your Account if any information provided is inaccurate, false, or violates these Terms.
4. Service Description
EnuMenu provides a digital menu and table ordering platform for restaurants. Our Service includes:
- Digital menu creation and management
- QR code generation for tables
- Customer ordering system
- Waiter dashboard for order management
- Multi-language menu support
- Real-time order tracking
- Takeaway ordering functionality (paid plans only)
- Integration with third-party payment providers for in-app payments
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
5. Subscription Plans and Payment
5.1 Free Plan
We offer a free plan that includes all core features with the following limitations:
- Limited to 1 table only
- Digital menu for customers
- Table ordering system
- Waiter dashboard with order management
- Multi-language menu support
- AI menu translation
- Real-time order tracking
- QR code generation
- Full admin panel access
The Free plan does not include takeaway ordering functionality. The Free plan is available indefinitely at no cost and is perfect for trying out EnuMenu before scaling up.
5.2 Paid Subscriptions
Paid subscriptions unlock unlimited tables and takeaway ordering functionality. All paid plans include the same features - pricing is based on the number of tables:
- Starter: Up to 10 tables + takeaway orders
- Professional: Up to 25 tables + takeaway orders
- Business: Up to 50 tables + takeaway orders
- Enterprise: 50+ tables or multiple locations (custom pricing)
Subscription fees are billed in advance on a monthly or annual basis. Annual billing provides a discount equivalent to two months free.
5.3 Payment Processing
All payments are processed through Paddle, our authorised payment processor. By subscribing to a paid plan, you agree to Paddle's terms of service. We do not store your payment card details.
5.4 Price Changes
We may change subscription prices with 30 days' notice. Price changes will not affect your current billing period but will apply to subsequent renewals.
6. Free Trial
We offer a 3-month free trial for all paid subscription plans. During the trial period:
- You have full access to all features of your selected plan
- No payment is required to start the trial
- No credit card is required upfront
- No obligations - the trial is completely free
At the end of the trial, if you choose not to subscribe, your account will automatically downgrade to the Free plan. There are no automatic charges - you only pay if you actively choose to subscribe.
7. Customer Payment Processing
7.1 Payment Facilitation
EnuMenu provides technology that enables Restaurants to accept payments from Customers through third-party Payment Providers (such as Stripe and Przelewy24). EnuMenu acts solely as a technology facilitator and does not:
- Process, hold, or control any funds from Customer orders
- Act as a payment processor or merchant of record for food and beverage orders
- Guarantee or be responsible for the completion of transactions between Customers and Restaurants
7.2 Direct Relationship
When a Customer makes a payment for an order:
- The payment is processed directly between the Customer and the Restaurant through the Payment Provider
- Funds are transferred directly to the Restaurant's account with the Payment Provider
- EnuMenu does not receive, hold, or have access to these funds at any time
- The Restaurant is the merchant of record for all food and beverage transactions
7.3 Payment Provider Terms
Use of payment features is subject to the terms and conditions of the applicable Payment Provider:
- Stripe: stripe.com/legal
- Przelewy24: przelewy24.pl/regulamin
Restaurants are responsible for maintaining their own accounts with Payment Providers and complying with all applicable Payment Provider requirements.
7.4 Refunds for Customer Orders
Since EnuMenu does not process or hold funds from Customer orders:
- Refunds for food and beverage orders must be requested directly from the Restaurant
- The Restaurant is solely responsible for their refund policies and processing refunds
- EnuMenu cannot process refunds for orders as we do not have access to the funds
- Any disputes regarding orders should be resolved directly between the Customer and Restaurant
8. Cancellation and Refunds
You may cancel your EnuMenu subscription at any time through your Account settings or by contacting us. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent billing periods
- Your account will automatically downgrade to the Free plan

Note: Our Refund Policy applies only to EnuMenu subscription fees paid to us through Paddle. It does not apply to payments made by Customers to Restaurants for food and beverage orders.
9. User Content
You retain ownership of any Content you upload to the Service, including menu items, descriptions, and images. By uploading Content, you grant us a worldwide, non-exclusive licence to use, display, and distribute your Content solely for the purpose of providing the Service.
You are responsible for ensuring that your Content:
- Does not infringe any third-party intellectual property rights
- Does not contain illegal, harmful, or offensive material
- Is accurate and not misleading
- Complies with applicable food labelling and allergen laws
10. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe the rights of others
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt the Service
- Collect or harvest user information without consent
- Use the Service for any fraudulent or deceptive purpose
11. Intellectual Property
The Service and its original content, features, and functionality are owned by EnuMenu and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.
12. Third-Party Services
The Service may contain links to or integrate with third-party services, including Payment Providers. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
We do not guarantee the accuracy, completeness, or usefulness of any information on the Service. Restaurant menu information is provided by the respective restaurants and we are not responsible for its accuracy.
We do not guarantee the availability, reliability, or performance of third-party Payment Providers integrated with our Service.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENUMENU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
EnuMenu shall not be liable for any losses, damages, or disputes arising from:
- Transactions between Customers and Restaurants
- Payment processing by third-party Payment Providers
- Refund disputes between Customers and Restaurants
- The quality, safety, or accuracy of products or services provided by Restaurants
15. Indemnification
You agree to indemnify and hold harmless EnuMenu and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms, including any claims arising from transactions with Customers or use of Payment Provider services.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the 'Last updated' date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
